POSSESSION OF A CONTROLLED SUBSTANCE

What is it?
|
| A person knowingly or intentionally possesses a controlled substance not having obtained the substance directly from or under a valid prescription or order of a practitioner acting in the course of a professional practice |

What is the punishment?
|
| Depends on the drug, the amount of the drug and penalty group the drug has been assigned to. Call our office for a list of the penalty groups. |

|
|
|
MANUFACTURE OR DELIVERY OF A CONTROLLED SUBSTANCE
|
|
What is it?
|
| A person knowingly manufactures, delivers, or possesses with intent to deliver a controlled substance |

What is the punishment?
|
| Depends on the lab results of the controlled substance, the aggregate weight including adulterants and dilutants. Most substances are tracked by either gram weight or units. Call our office for more information. |

UNLAWFUL CARRYING WEAPONS

What is it?
|
| A person intentionally, or knowingly or recklessly carries on or about his person a handgun, illegal knife or club |

What is the punishment?
|
| 3rd Degree Felony if the Offense is committed on any premises licensed or issued a permit by this state for the sale of alcoholic beverages. |

|
|
|
|
PROHIBITED WEAPONS
|
|
What is it?
|
| A person intentionally or knowingly possesses, manufactures, transports, repairs or sells (a) an explosive weapon (b) a machine gun (c) a short barreled firearm (d) a firearm silencer (e) a switchblade knife (f) knuckles (g) armor-piercing ammunition (h) a chemical dispensing device or (i) a zip gun. |

| 3rd Degree Felony unless it is a switchblade knife or knuckles. Then it is a Class A misdemeanor. |

|
|
|
|
BURGLARY
|

What is it?
|
| A person, without the effective consent of the owner enters a building or habitation and commits or attempts to commit a felony, theft or assault |

1st Degree Felony if committed in a habitation with the intent to commit another felony 2nd Degree Felony if committed in a habitation

SEXUAL ASSAULT

| A person intentionally or knowingly (a) causes the penetration of the anus or sexual organ of another person by any means, without that person’s consent (b) causes the penetration of the mouth of another person by the sexual organ of the actor, without that person’s consent; or (c) causes the sexual organ of another person, without the consent, to contact or penetrate the mouth, anus or sexual organ of another person |

THEFT
|

RESISTING ARREST, SEARCH, OR TRANSPORTATION

|
What is it?
|
| A person intentionally prevents or obstructs (a) a person he knows is a peace officer; or (b) a person acting in a peace officer’s presence and at his direction from effecting an arrest, search, or transportation of the actor or another by using force against the peace officer or another. |

|
|
What is the punishment?
|
|
3rd Degree Felony if the actor uses a deadly weapon to resist the arrest or search.

|
RESISTING ARREST, SEARCH, OR TRANSPORTATION

What is it?

ONLINE SOLICITATION OF MINOR
|

What is it?
|
| A person who is 17 years of age or older with the intent to arouse or gratify the sexual desire of any person over the internet or by electronic mail or commercial online service intentionally (a) communicates in a sexually explicit manner with a minor; or (b) distributes sexually explicit material to a minor. |
|
|
|
What is the punishment?
|
|
2nd Degree Felony if the minor is younger than 14years of age or is an individual whom the actor believes to be younger than 14 years of age
