Felony Charges – Felony Lawyer
There are so many felony charges that it would be impossible to list each and every crime included in The Texas Penal Code. Instead, we have included a brief outline of the most common felony charges for your review. Just because you don’t see the crime you have been charged with below does not mean that we do not handle your type of case. POSSESSION OF A CONTROLLED SUBSTANCE
What is it?
A person knowingly or intentionally possesses a controlled substance not having obtained the substance directly from or under a valid prescription or order of a practitioner acting in the course of a professional practice
What is the punishment?
Depends on the drug, the amount of the drug and penalty group the drug has been assigned to. Call our office for a list of the penalty groups.
MANUFACTURE OR DELIVERY OF A CONTROLLED SUBSTANCE
What is it?
A person knowingly manufactures, delivers, or possesses with intent to deliver a controlled substance
What is the punishment?
Depends on the lab results of the controlled substance, the aggregate weight including adulterants and dilutants. Most substances are tracked by either gram weight or units. Call our office for more information.
UNLAWFUL CARRYING WEAPONS
What is it?
A person intentionally, or knowingly or recklessly carries on or about his person a handgun, illegal knife or club
What is the punishment?
3rd Degree Felony if the Offense is committed on any premises licensed or issued a permit by this state for the sale of alcoholic beverages.
PROHIBITED WEAPONS
What is it?
A person intentionally or knowingly possesses, manufactures, transports, repairs or sells (a) an explosive weapon (b) a machine gun (c) a short barreled firearm (d) a firearm silencer (e) a switchblade knife (f) knuckles (g) armor-piercing ammunition (h) a chemical dispensing device or (i) a zip gun.
What is the punishment?
3rd Degree Felony unless it is a switchblade knife or knuckles. Then it is a Class A misdemeanor.
BURGLARY
What is it?
A person, without the effective consent of the owner enters a building or habitation and commits or attempts to commit a felony, theft or assault
What is the punishment?

1st Degree Felony if committed in a habitation with the intent to commit another felony
2nd Degree Felony if committed in a habitation

State Jail Felony if committed in a building not a habitation
SEXUAL ASSAULT
What is it?
A person intentionally or knowingly (a) causes the penetration of the anus or sexual organ of another person by any means, without that person’s consent (b) causes the penetration of the mouth of another person by the sexual organ of the actor, without that person’s consent; or (c) causes the sexual organ of another person, without the consent, to contact or penetrate the mouth, anus or sexual organ of another person
What is the punishment?

2d Degree Felony
2-20 years in prison
$10,000.00 maximum

THEFT
What is it?
A person appropriates property with the intent to deprive the owner of property without the owner’s effective consent.
What is the punishment?

Ranges from a 3rd Degree felony to State Jail Felony.

Depends on the value of the property alleged to be taken as well as prior criminal history. Call our office for further information.
UNAUTHORIZED USE OF A VEHICLE
What is it?
A person knowingly or intentionally operates another’s boat, airplane, or motor-propelled vehicle without the effective consent of the owner.
What is the punishment?

State Jail Felony

2 years maximum jail sentence
CREDIT CARD OR DEBIT CARD ABUSE
What is it?
A person with intent to obtain a benefit fraudulently presents or uses a credit card or debit card (a) with knowledge tha the card, whether or not expired, has not been issued to him and is not used with the effective consent of the cardholder; or (b) with knowledge that the card has expired or has been revoked or cancelled
What is the punishment?

State Jail Felony

2 years maximum jail sentence
RESISTING ARREST, SEARCH, OR TRANSPORTATION
What is it?
A person intentionally prevents or obstructs (a) a person he knows is a peace officer; or (b) a person acting in a peace officer’s presence and at his direction from effecting an arrest, search, or transportation of the actor or another by using force against the peace officer or another.
What is the punishment?

3rd Degree Felony if the actor uses a deadly weapon to resist the arrest or search.

10 years maximum jail sentence
RESISTING ARREST, SEARCH, OR TRANSPORTATION
What is it?
A person intentionally prevents or obstructs (a) a person he knows is a peace officer; or (b) a person acting in a peace officer’s presence and at his direction from effecting an arrest, search, or transportation of the actor or another by using force against the peace officer or another.
What is the punishment?

3rd Degree Felony if the actor uses a deadly weapon to resist the arrest or search.

10 years maximum jail sentence
EVADING ARREST OR DETENTION
What is it?
A person intentionally flees from a person he knows is a peace officer (a) attempting to lawfully arrest him; or (b) attempting to lawfully detain him
What is the punishment?

Can range from a State Jail Felony to 3rd Degree Felony depending on previous criminal history and if bodily injury occurs during the episode. Call for more information.
ONLINE SOLICITATION OF MINOR
What is it?
A person who is 17 years of age or older with the intent to arouse or gratify the sexual desire of any person over the internet or by electronic mail or commercial online service intentionally (a) communicates in a sexually explicit manner with a minor; or (b) distributes sexually explicit material to a minor.
What is the punishment?

2nd Degree Felony if the minor is younger than 14years of age or is an individual whom the actor believes to be younger than 14 years of age

State Jail Felony for all other alleged violations
